Terms of Service

1. Acceptance of Terms

By registering for, accessing, or using the Whacaster platform and services ("Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the Services on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

2. Description of Services

Whacaster is a SaaS platform providing technology solutions for businesses to integrate with the Meta WhatsApp Business API. Our Services include:

• Access to the WhatsApp Business API for sending and receiving messages
• Multi-agent inbox and conversation management tools
• Bulk message broadcasting and campaign management
• Chatbot and automated response flow builder
• CRM contact management and segmentation
• Analytics, reporting, and performance dashboards

We act as a Business Solution Provider (BSP) for the Meta WhatsApp Business API. Use of WhatsApp features is also subject to Meta's own terms and policies.

3. Eligibility

• Be at least 18 years of age
• Be a legal business entity or individual operating a legitimate business
• Have a valid Meta Business Manager account
• Comply with all applicable laws in your jurisdiction

4. Account Registration and Security

You agree to provide accurate registration information, keep your password confidential, and be fully responsible for all activity under your account. Notify us immediately of any unauthorized use at support@whacaster.com.

5. Meta Platform Compliance

By using our Services, you agree to comply with all applicable Meta policies, including:

• WhatsApp Business Terms of Service
• Meta Commerce Policy
• Meta Platform Policy
• WhatsApp Messaging Guidelines (opt-in requirements, template approval policies)

6. Acceptable Use Policy

You agree NOT to use the platform to:

• Send unsolicited messages (spam) to recipients who have not opted in
• Transmit content that is illegal, fraudulent, deceptive, or harassing
• Engage in phishing, scams, or impersonation of any person or entity
• Violate any applicable law including privacy laws and anti-spam regulations
• Sell, resell, or sublicense platform access without prior written consent
• Attempt to reverse engineer or extract the source code of our platform
• Promote products prohibited under Meta's Commerce Policy

7. Subscription, Fees, and Payment

7.1 Subscription Plans

Whacaster offers various subscription plans as described on our platform. We reserve the right to modify pricing with 30 days' notice.

7.2 Payment

Subscription fees are billed in advance on a monthly or annual basis in IDR or USD as specified at checkout.

7.3 Additional Charges

WhatsApp Business API usage may incur additional charges based on Meta's per-conversation pricing, passed through to you separately from subscription fees.

7.4 Refunds

Subscription fees are non-refundable except as required by applicable law. Cancellation retains access until the end of the billing period.

8. Data & Privacy

Your use of the Services is subject to our Privacy Policy. You retain ownership of all data you input into the platform. You grant us a limited license to process and store your data solely to provide the Services.

9. Intellectual Property

The Whacaster platform, including all software, interfaces, and logos, is the exclusive property of Whacaster. You are granted a limited, non-exclusive, non-transferable license to use the platform during your subscription term.

10. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WHACASTER'S TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 3 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR ACTIONS TAKEN BY META, INCLUDING SUSPENSION OF YOUR WHATSAPP BUSINESS ACCOUNT.

11. Termination

Either party may terminate this agreement. We may suspend or terminate your access immediately if you breach these Terms or Meta's policies, or with 30 days' notice for any other reason. Upon termination, you may request a data export within 30 days.

12. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Indonesia. Disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to courts of competent jurisdiction in Indonesia.

13. Changes to These Terms

We may modify these Terms at any time with at least 30 days' notice for material changes via email or platform notice. Continued use after the effective date constitutes acceptance.
